Below you will find topics relevant to Personal Injury Law in Texas, and some common questions concerning insurance coverage for serious auto and truck accidents.
What should I do after a car wreck?
Read MoreIf you are in a car accident in the Houston area, then there are 3 things you should do.
- Get medical attention immediately.
- Call the police and get a police report.
- Call a licensed personal injury attorney in your area.
How much insurance do I need?
In general, you should get as much as you can reasonably afford. Try to calculate how much it would cost your family if you or a passenger needed major surgery, or if you could not work for several months due to your injuries.
- Uninsured Motorists (UIM) coverage can protect you if the other driver has no coverage or low coverage.
- Personal Injury Protection (PIP) can reimburse your medical expenses and up to 80% of lost wages.
- Make sure your own Liability Coverage is high enough to protect you from lawsuits if you are deemed at-fault in a collision.
Some insurance providers will try to offer cheap, limited plans plans where you "pay only for what you need". In reality, these plans often give you much less than what you need.
Should I choose PIP or MedPay?
When choosing auto insurance coverage, you may choose either Personal Injury Protection (PIP) or MedPay coverage.
- PIP covers everyone in the insured auto up to PIP coverage limits.
- PIP will pay medical bills, reimburse you for out of pocket coverage and reimburse you for lost wages.
- You do not have to pay your insurer back for the money you received from PIP.
- Medpay covers only medical expenses, and you may have to pay it back.
In general, choosing the highest PIP coverage limit you can afford is a good way of protecting you and your loved ones in the event of a serious crash.
What is the Texas Good Samaritan Law?
The Texas Good Samaritan Law protects citizens who render aid to another person during an emergency.
For example, if you administer CPR to a person and inadvertantly break their ribs, you would not be held liable for their injury. Or, if you tried to assist someone suffering a heart attack with an electric defibrilator, you would not be punished for any accidental harm you inflicted.
As long as you act in a way that is sincerely intended to help, and do not act in a irrational or wantonly negligent way, this law protects you. In this way, the Texas Good Samaritan Law encourages Texans to help each other when they are in need of emergency care.
What questions should I ask my lawyer?
If you have been seriously injured and you’d like to hire a personal injury lawyer, there are a few questions that you should ask early on the legal process.
- Who Will Actually be Handling My Claim?
- Is The Attorney Board Certified?
- How Much Experience Does Your Lawyer Have?
